Matthews v. Warren Case File

Introduction by Robert W. Keyes:

Matthews v. Warren is a civil suit filed in Augusta County,
Virginia Aug 2, 1803 by the heirs of Robert Matthews of Berks Co.,
Pennsylvania against the heirs of Michael Warren of Rockingham Co.,
Virginia (and also from Berks Co., Pennsylvania) who was the executor
of Robert Matthews’ estate. The suit contains a number of receipts
and letters of attorney as exhibits which to the best of my ability
have been transcribed below. The order of documents contained in the
copy received by this author could not be readily determined as there
were copies often with several documents on one page. Therefore, I
have tried to order the documents by date or by relevance
to each other. I have tried to maintain the spelling and punctuation
to the best of my ability but made little attempt to maintain the
positioning of handwriting on the original documents as some were
written with great flair or on scraps of paper which add little to
the actual content. I have included at the end of this document a
list of possible additional sources, primarily consisting of original
source documents, that may be of interest to the reader attempting to
identify and verify the ancestry of individuals referenced in
Matthews v. Warren or within
the referenced sources. I have, within the list of additional
sources, added highlighting as a aid to the reader in identifying
individuals possibly related to those identified within
Matthews
v. Warren
. No attempt has been
made within this document to identify any family relationships and
that is left to the reader to draw their own conclusions. All
comments enclosed in brackets were added by this author.

Robert Mathews by his Testament, leaves his whole Estate to his
Wife during her widowhood, and if she married or dies, then the
Estate was to be sold by his Executrix & Executor & the
proceeds divided amongst his Children as pr. Will – he appoints
his wife Mary & Michael Warren his Executrix & Executor.
Michael Warren only qualified, his wife married and is also now dead
– the lands were sold by the Ex’or Warren There was
considerable personal Estate – Michael Warren is since dead,
John Ewin & Nathaniel Harrison are his acting Ex’ers –
John, Townsend, Amelia, Robert, and Rebecca, Mary & Solomon were
the Children & devises of Robt Mathews decd. John is dead,
leaving two children Hannah, & Martha Mathews of full ages.
Hannah is married to Wm Ratchford, & Martha is the widow Dunavan
– all the rest are alive, Amelia is married to Robert Dickey
— Rebecca to Benjamin Webb & Mary to James Webb. The Ex’ors of
Warren refuse to show the papers of their Testator —

The Commonwealth of Virginia to the Sherriff of Rockingham County
greeting.

Your are hereby commanded to summon John Ewin and Nathaniel
Harrison Executors of Michael Warren decd who was the only acting
Exor of Robert Matthews decd to appear before the Judge of the
Chancery District Court to be holden at Staunton on the first day of
the next term to answer a bill in Chancery exhibited against them by
Solomon Matthews Town send Matthews and Robert Matthews. Robert
Dickey and Amelia his wife late Amelia Matthews, Benjamin Webb and
Rebecca his wife late Rebecca Matthews, James Webb and Mary his wife
late Mary Matthews which said Soloman, Townsend, Robert, Amelia,
Rebecca and Mary are the children and devises of Robert Matthews decd
and William Ratchford and Hannah his wife, late Hannah Matthews, and
Martha Dunavan, a widow, late Martha Matthews, which said Hannah and
Martha are the children and Heirs at law of John Matthews decd who
was the son and one of the Devises of the said Robert Matthews decd.
And this they shall in no wise omit under the Penalty of L100 each
and have them there this writ Witness Henry James Peyton Clerk of the
said Court at Staunton this 28th day of May 1802 and in
the 26th year of this Commonwealth.

District Court, humbly complaining respectfully sheweth unto your
honour, your Orators & Oratrixes Soloman
Mathews, Townsend Mathews, & Robert Mathews, Robert Dickey &
Amelia his wife, late Amelia Mathews, Benjamin Webb & Rebecca his
wife, late Rebecca Mathews, James Webb & Mary his wife, late Mary
Mathews, which said Soloman Townsend, Robert, Amelia, Rebcca &
Mary are Children & Devises of Robert Mathews decd and William
Ratchford & Hannah his wife, late Hannah Mathews, & Martha
Dunavan, a widow, late Martha Mathews, which said Hannah & Martha
are the children & heirs at law of John Mathews decd who was one
of the sons & one of the Devises of the sd Robert Mathews decd,
That their ancestor the sd Robert Mathews
whose place of
residence was in the County of [blank space] in the State of
Pensylvania departed this life on or about the [blank] day of [blank]
in the year [blank] having first made & duly published his last

may be taken as part of this their bill – In which sd last will
& Testament there is a Devising Clause in substance as followeth
towit, “that his Wife Mary shold have & enjoy all his real
& personal Estate during her natural life or widowhood, and at
her death or upon her marrying the whole Estate was directed to be
sold by his Executrix Executor, & the proceeds thereof equally
divided amongst all his Children; and constituted & appointed his
wife Mary & Michael Warren his Ex’trix & Executor thereof, of
whom the latter duly qualified

and your Orators & Oratrixes further shew that the sd Mary the
wife of the sd Testator did marry in some short time after his death;
and the lands together with the personal Estate of the Testator
(which was considerable) were sold, but no account rendered thereof
by the sd Warren, or any party or if any very small proportions paid
to ye Orators & Oratrixes – and the sd Michael Warren is
since Decd, to whom John Ewim & Nathaneil Harrison are Ex’ors; &
and are in possession of all the Papers (and whom ye Orators &
Oratrix– pray may be made Defend’s t this Bill) relative to his
Executors wife, of the first Testator but refuse suffer ye orators &
oratrixes to see them altho they have been often called upon in a
friendly manner for a sight of them nor will they render any acct of
sd Executorship all which actings & doings of the sd Defend’nt
are contrary to equity & good conscience and tend to defraud &
injure your Orators & Oratrixes In tend or consideration whereof
they pray that the commnrs writ of Subs. May issuue to compel the sd
Defend’ts to answer the premises & produce the papers of their
Testator, relative to his Executor ship of the first Testator __ and
that they may have such further & other receipts as your honour
may deem just & equitable your Orators & Oratrixes pray &
as in duty bound will ever pray.

The answer of John Ewin and Nathaniel Harrison to a bill of
complaint exhibited
against them in the Chancery district court
Holden at Staunton as executors of Michael Waren decd who was the
acting executor of the Last Will an testament of Robt Mathews decd by
Solomon Mathews and other children and heirs of the said Robt decd.
Complainants. These defendants having to themselves all manner of
exceptions to the many untruths ?? in the said bill contained, for
answer thereto say that they admit their testator this testator was
the executor of Robt Mathews decd that he made his will as is stated
in the bill of the complainants, and that these Dfts are the
executors of Michael Waren decd. They are Entirely ignorant of the
amount of the personal estate of Robt. Mathews decd nor can they find
any papers to inform them thereof but they have always understood it
to be very inconsiderable the land They know not what the land was
worth except from an old paper which they find among the ??? the
papers of their testator dated 21st day of May 1754 which shows it
was sold at 133 – for
to Thomas Kerby and they find some accounts which appear to have been
paid by the Executor Michael Waren. Towit for
15 : 12 : 5 and one for
9 : 0 : 7 — and one for taxes which exhibits marked A. B. C. D.
These Dftts pray may be taken as apart of this their answer. These
Dfts in further answer state that they find among the papers of their
testator receipts from all the

heirs for their part of the estate of their father given to the
said Michael Waren except as to the part of Townsend and Amilia
Mathews for whose share they find no rect except a paper signed by
William Boone but not dated but from the hand writing it appears
anceint. — Which receipts and the last mentioned papers these defts
pray may be taken as a part of this their answer and by which it will
appear Solomon who these Dfts believes is the mover in this business
is fully paid up his share — which receipts ???? are of an ancient
date — They further state that Amelia married Robert Dickey who is
dead since the commencement of this suit and has in his lifetime
informed these Defts that he had recd the part coming to his wife and
had no demands against the estate and that the suit was brought
without his privity knowledge or consent, and ???? that he had given
Michael Waren a receipt for the same, and which these Dfts think they
once seen but cannot find it at this time tho they have made diligent
search therefore — and believe if was it ???? rest it is lost —
They are also inclined to believe that Townsend part has been paid
him by Boone. They do most expressly state that they have been
informed by good authority that Solomon has brought Suit without the
consent of any of the

others. And tht he has said he knew the whole estate was fully
paid up but that Michael Waren was a carless old man would loose the
papers, soon die, and he would make the young ones pay the debts over
again. These defendants believe he has religiously kept to his word.
For Michael Waren lived in the neighbourhood of the said Solomon and
all the others (except John) for a number of years and they never
pretended there was any thing coming to them until since the death of
the said Michael Waren. ——– In hopes that the papers might be
lost he Solomon has now commenced this suit. These Defendts do state
that they are fully satisfied that the whole business has long since
been finally and fairly settled and all the children fully paid up
their parts. They hope that before the court will decree ????? an
account or any money to be paid that the Complainants will make ample
proof of their clains when the same has been suffered to sleep for
upwards of forty years and during all that time they living in the
very neighbourhood of the executor Michael Waren who decd but a few
years ago. —– These defendants further state that another reason
why they believe Townsend was fully paid is that he lived wh??th?
with Michl Waren the executor a number of years and was poor. And
the said Michael Waren the executor was in very easy circumstances.
And during the

whole of their acquaintance with him which has been upwards of
forty years never heard him charged with any dishonest act but on the
contrary he was always considered a very punctual upright honest man
and they are well satisfied has long before his death fully settled
with all the heirs.—– These defendants denies all unlawfull
combination ?? and pray hense to be dismissed with their costs most
unjustly sustained.

of the peace in and for said County that the foregoing answer so far
as is stated to be of their own knowledge they ?????? is true. and
any thing therein stated to be by information of others they believe
to be true.

Whereas there is a Vandue intended this Day to be of the
plantation of Robert Matthews Deceasd of ?o acres Be it therefore
Known to all people that the following are the conditions upon which
the said place is to be Disposed of Dated the 25 Day of May 1754

First that the highest bidder shall be the buyer or purchaser

Secondly that the said purchaser shall pay one half of the
purchase money at or upon the first Day of April next and the other
half of the said purchase money upon the first Day of April following
which will be in the year 1756

And 3dly that the said Buyer or purchaser shall pay any Reasonable
Bond or Obligations for the above payments as the Ex’ors of the said
Robt Matthews shall Desire___

If the purchasur shall chuse it he may have liberty to make three
payments of the last half of the above mony that is to [ink blot]
quarter of the whole mony in five years and [ink blot] of said mony
then to be Divided in two parts and one part pa[ink blot] seven years
and the other part at the Expiration of thirteeen years with Lawful
Interest

in the Province of Virginia Cordwainer my true and lawful Attorney
for me and in my Name and for my Use to ask, demand, sue for, levy
recover and receive all such Sum & Sums of Money, Debts, Goods,
Wares, Dues, Accompts and other Demands whatsoever which are or shall
be due, owing, payable and belonging to me or detained from me by any
Manner of Ways or Means whatsoever by Michael Warren of Augusta

Will of the aforesaid Robert Mathews deceased or by any other Person
or Persons whomsoever having in their or his Hands the Portion, Part
or Share of my said Wife Rebecca of and in the Extate of her said
Father Robert Mathews, giving and granting unto my said Attorney by
these Presents my full and whole Power Strength and Authority in and
about the Premises to have, use and take all lawful Ways and Means in
my Name for the Recovery thereof And upon the Receipt of any such
Debts Dues or Sums of Money aforesaid. Acquittances or other
sufficient Discharges for me and in my Name to make real and deliver.
And Generally All and every other Act or Acts, Thing and Things,
Device and Devices in the Law whatsoever useful and necessary to be
done in and about the Premises for the Recovery of all or any such

that Solomon Matthews the Constituent and Robert Matthews the
Attorney within named And the said Solomon Matthews having, in my
Presense and in the Presense of the subscribing witnesses hereto,
