Will of James Hindman
East Franklin Township,
Armstrong County Pennsylvania
In the name of God Amen, I, James Hindman of the township of East Franklin,
county of Armstrong and State of Pennsylvania, farmer, being of sound mind,
memory and understanding do make and publish this my last will and testament,
hereby revoking and making void all former wills by me at any time heretofore
made.And first I direct that my body be decently interred in the Cemetery in
said township according to the rules(?) and ceremonies of the Presbyterian
Church; and that my funeral be conducted in a manner corresponding with my
estate and situation in life; and as to the estate which it hath pleased God
to invest me with, I dispose of the same as follows to wit:Item. I give and bequeath, subject to the conditions hereinafter mentioned,
to Benjamin Lee Toy and Rachael Toy his wife, in common and their heirs and
assigns forever, the farm on which I now live containing about ninety-five
acres more or less, situated in said East Franklin township, and county and
state.And further it is my will that my beloved wife Jane shall have the one
third of all that will and may be produced from year to year during her
natural life upon, from and out of the farm which I have just devised to the
said Benjamin Lee Toy and Rachael his wife — they the said Benjamin and
Rachael to till and work or have tilled and worked the said farm to the best
advantage so far as their skills and knowledge extends furnishing to my said
wife Jane her share as aforesaid of all the products in good condition with
the hay and fodder well taken care of, the grain in the garner and the corn in
the crib, they keeping said farm in good repair and paying all taxes which is
or may be assessed upon the same from year to year. It is also my will and
desire that my wife shall have the sole occupancy and possession of the house
we now live in, together with the use and (services?) of the north half of the
garden attached to the same, and which we all now using, during her natural
life.It is my will that Annie Lytle, the girl now living with us, when she
arrives at the age of eighteen years, shall have one milk cow and one bed the
same to be a charge upon my estate (until the mine?) is complyed with.Item: I give and bequeath to Rosannah Toy daughter of said Benjamin and
Rachael Toy my side saddle. I also give and bequeath to Robert Hamilton Toy,
son of said Benjamin and Rachael Toy my man’s saddle. All the rest and (___?)
of my personal property whatsoever and whichsoever of what nature, kind and
quality soever the same may be, and not hereinbefore given were disposed of
after paying my debts, (legacient?) and funeral expenses, I give and bequeath
unto my beloved wife Jane to and for (one complete line unreadable). I do
hereby constitute and appoint my friends John Kennerdell, Sr., and George S.
Rohrer of the borough of Kittanning and county aforesaid, the executors of
this my last will and testament.In order whereof, I, James Hindman, the testator, have to this my wills,
written on one sheet of paper, setting hand and seal this twenty-second day of
September, one thousand eight hundred and seventy-seven..s/ James Hindman

and for his last will and testament in the presence of us, who have hereunto
subscribed our names as witnesses thereto, in the presence of the said
